The Labour Market Impact Assessment is a document a employer has to obtain before employing a foreign worker. This assessment must be applied for by the employer, not the employee. A positive LMIA indicates the vacancy is for a foreign worker and no Canadian is available for the job. After the employer’s LMIA is obtained, it is sent to the foreign worker. The worker must attach the LMIA with the work permit application to work in Canada. The employer must fulfill the following requirements to apply for the LMIA-
1. No past agreement issues as an employer
2. The capacity to fulfill all the terms of the offer (submission of tax documents is required)
3. They are providing quality service in Canada
4. Proof of the business being in operation for minimum one year to hire skilled foreign worker.
5. They are offering employment that fulfills the needs of their business.
The requirements for a LMIA vary depending on the offered job position. The fee for application is $1000 for each position.
